IMSS pension simulator: Ley 73, Ley 97 and Modalidad 40

Three simulators and a longevity illustrator built on the parameters in force in 2026: the UMA, the minimum wage, the table in Article 167 of the 1973 Ley del Seguro Social (Social Security Law), the contribution rates of the 2020 reform and the CNSF’s EMSSA mortality tables. Every result shows the full calculation so you can check it line by line.

What this simulator is for

An IMSS (Mexican Social Security Institute) pension is, in actuarial terms, a life annuity whose amount depends on very precise legal rules: the regime you belong to, the weeks the Institute recognizes, the salary on which you contributed and the age at which you retire. Two people with the same career can receive very different pensions if one retires at 60 and the other at 65, or if one contributed on a high salary in their last five years and the other did not.

This page brings together in one place the three questions most often asked in Mexico: how much will I get under Ley 73, is Modalidad 40 worth it, and what can I expect from my AFORE (retirement fund manager) under Ley 97. To these it adds a fourth question that hardly anyone asks and that determines whether the money will last: how many years will I live after retiring.

It is designed for two audiences. If you are planning your retirement, you will find plain-language explanations and simulators you can fill in with the data from your statement of contribution weeks. If you advise others, each simulator displays a step-by-step breakdown, with the legal articles behind it, so you can compare it with an IMSS pension resolution or with your own spreadsheet. The broader context is in the pensions guide and in the pensions and AFORES specialty.

02

How to tell whether you are Ley 73 or Ley 97

The rule is a date. The current Social Security Law (LSS) came into force on July 1, 1997 and at that moment repealed the law published on March 12, 1973 (First Transitory Article). If you were registered with the IMSS before that date, even if you contributed only a few weeks in a summer job, you belong to the transition generation: when you meet the requirements you can choose to retire under the former law or the current one (Third and Eleventh Transitory Articles). If your first registration was on or after July 1, 1997, only Ley 97 applies to you, with an individual account at an AFORE.

Your registration date appears on your statement of contribution weeks. It does not matter how long you stopped contributing or how many times you changed jobs: what gives you the right to choose is having been registered before the change in law. The Fourth Transitory Article requires the IMSS, on request, to estimate your pension under both regimes so you can decide.

Almost everything changes between the two: who pays, how it is calculated and how much you need to contribute.

Rule of thumb: if you are in the transition generation, it almost always pays to compare both calculations. Ley 73 rewards high salaries at the end of the career and many weeks; Ley 97 rewards savings accumulated over the whole working life and investment returns.

How the IMSS calculates a Ley 73 pension

The vejez or cesantía en edad avanzada (old-age unemployment) pension under the 1973 law consists of a basic amount and annual increments for every 52 weeks contributed after the first 500 (Article 167). Both are percentages of the average daily salary over the last 250 weeks, and they depend on the salary group: that average is expressed as a multiple of the general minimum wage in force on the date you retire. Those who earn little receive a high basic amount (80% of salary if they earn up to one minimum wage) and small increments; those who earn more than six minimum wages receive a 13% basic amount, but 2.45% for each additional year.

Fractions of a year also count: 13 to 26 leftover weeks earn half an increment and more than 26 earn a full one. The cesantía factor by age is then applied to the vejez pension, from 75% at age 60 to 100% at 65. Next come the family allowances of Article 164: 15% for a wife or common-law partner and 10% for each child under 16 (or up to 25 if studying, with no limit if disabled); if there is no wife and no children, 10% for each parent financially dependent on the pensioner, and if there are none of these, a 15% assistance supplement. The IMSS adds a 10% assistance supplement when the pensioner has only one dependent parent.

Two limits close the calculation. Article 168 sets a floor: the pension, including allowances, cannot be less than one general minimum wage. Article 169 sets a ceiling: it cannot exceed 100% of the average salary used as its basis. Finally, the Fourteenth Transitory Article of the decree published in the DOF on December 20, 2001 (amended on January 5, 2004) multiplies by 1.11 the pensions of those aged 60 or older who receive at least one minimum wage; that is why the 2026 minimum pension is $315.04 × 365 ÷ 12 × 1.11 = $10,636.53. Article 167 also grants a year-end bonus (aguinaldo) equal to one monthly payment.

Annual pension before limits
\[P = \bar S \cdot 365 \cdot \left(c_b + n\, i_a\right) \cdot f_e \cdot \left(1 + a\right)\]

\(\bar S\) is the average daily salary over the last 250 weeks (capped), \(c_b\) and \(i_a\) the basic amount and annual increment of the salary group, \(n\) the number of increments (one for every 52 weeks after the first 500, with half increments), \(f_e\) the cesantía factor by age and \(a\) the sum of family allowances or assistance supplement.

Limits and decree
\[P_{final} = 1.11 \cdot \max\left\{\min\left(P,\; 365\,\bar S\right),\; 365\,SM\right\}, \qquad P_{monthly} = \frac{P_{final}}{12}\]

The minimum of 365 minimum wages a year comes from Article 168 and the maximum of 365 times the average salary from Article 169. The 1.11 factor applies to pensioners aged 60 or older under the 2001 decree.

Ley 73 requirements

Cesantía: age 60, at least 500 recognized weeks and having lost paid employment. Vejez: age 65 and 500 weeks. The pension is paid from the date it is claimed and withdrawal from the mandatory regime is proven.

The salary cap: 25 times, 10 times or 25 UMA. Article 33 of the 1973 law, as amended in 1993, set a general limit of 25 minimum wages on the contribution salary, but 10 for the disability, old-age, cesantía and death insurance branches. The Second Chamber of the Supreme Court held in case law 2a./J. 85/2010 that the average salary over the last 250 weeks is capped at 10 minimum wages, a holding reaffirmed in 2a./J. 164/2019, published on January 24, 2020. The IMSS, however, keeps the cap at 25 minimum wages: its Technical Council unanimously ratified it on February 6, 2020. The simulator uses 25 by default and lets you switch to 10.

In practice there is a third limit that now matters more. Since the constitutional deindexation reform (DOF, January 27, 2016), references to the minimum wage as a unit of measure are read as references to the UMA, and the IMSS caps the contribution base salary at 25 UMA. Because the minimum wage has grown faster than the UMA, in 2026 the contribution cap is $2,932.75 a day, below even 10 minimum wages ($3,150.40). Anyone who contributed at the cap in their last five years will have an average below either of the two limits in the court debate. By contrast, the minimum wage, not the UMA, is used to determine the salary group and the minimum pension; a collegiate court held that the UMA cannot be applied to calculate pension increments (isolated thesis I.6o.T.170 L, 2019).

Modalidad 40: voluntary continuation

Modalidad 40 is voluntary continuation in the mandatory regime. It is now governed by Article 218 of the current law: anyone with at least 52 contribution weeks in the last five years who has left covered employment can keep contributing on their own to the disability and life and the retirement, cesantía and vejez insurance branches, registered with their last salary or a higher one, paying monthly in advance. The right is lost if it is not requested in writing within five years of leaving covered employment (Article 219), and enrollment ends, among other reasons, if you miss two monthly payments (Article 220).

For someone under Ley 73, the appeal is arithmetic. The pension depends on the average of the last 250 weeks, so contributing for about five years on a high salary replaces that average, and every week paid also adds increments. The salary that can be registered is capped at 25 daily UMA, $2,932.75 in 2026, equivalent to 9.31 minimum wages: it falls in the highest group of the Article 167 table.

The cost, however, has changed. In Modalidad 40 you pay the full employer and employee contributions: retirement (2%), employee cesantía and vejez (1.125%), disability and life (1.75% employer and 0.625% employee, Article 147) and pensioners’ medical expenses (1.05% and 0.375%, Article 25), which add up to a fixed 6.925%, plus the employer cesantía and vejez contribution, which the 2020 reform raises every year until 2030. For salaries of 4.01 UMA and above, the total rate goes from 13.347% in 2025 to 14.438% in 2026 and will reach 18.800% in 2030.

Ley 97: individual account, guaranteed pension and top-up

Under Ley 97 the pension is funded by your individual account balance. To qualify for a cesantía pension you need to be 60, and 65 for vejez (Articles 154 and 162), and in both cases the weeks set by the Fourth Transitory Article of the reform published in the DOF on December 16, 2020: 750 in 2021, 25 more each year, 875 in 2026 and 1,000 from 2031. If you reach the age without the weeks, you can withdraw your balance as a lump sum or keep contributing; with at least 750 weeks you keep medical coverage. If you never used your housing loan, the balance of that subaccount is transferred to the AFORE to purchase the pension (Article 40 of the INFONAVIT Law).

There are three contributions to the retirement, cesantía and vejez subaccount: 2% for retirement paid by the employer, 1.125% for cesantía and vejez paid by the employee, and the employer cesantía and vejez contribution, which since 2023 depends on salary and rises every year until 2030 (Article 168 and Second Transitory Article). For those earning up to 4 UMA, the Federal Government also deposits a social contribution per day contributed, indexed quarterly to the INPC. A 2026 detail: because the minimum wage ($315.04) equals 2.69 UMA, the bracket from 1.01 minimum wages to 1.50 UMA is empty in practice, and someone earning a little over the minimum contributes in the 2.51 to 3.00 UMA bracket.

How the balance becomes a pension. On retirement you choose between a life annuity, which you buy from an insurer and which pays you for life, and a programmed withdrawal, which the AFORE recalculates each year from your balance and your life expectancy. In both cases the monthly amount is, in essence, the balance divided by an annuity factor: the present value of paying one peso a month for as long as you live. The simulator calculates it with the CNSF’s EMSSA-15 table and its improvement factors, at the real rate you choose, and presents it as an approximation: an actual life annuity also includes survivors’ insurance for your beneficiaries and the insurer’s expenses, which reduce the amount.

Guaranteed pension. If your balance falls short, the State guarantees a minimum pension that, since the 2020 reform, depends on three variables: your age, your weeks and your career average salary, adjusted for inflation and expressed in UMA (Article 170). The statutory table is in 2020 pesos and is indexed every February with the INPC; with the cumulative factor of 1.3503, its 2026 values range from about $3,540 to $11,128 a month. The week columns shift every year: in 2026 the first corresponds to 875 weeks and the last to 1,125 or more. If your calculated annuity exceeds by more than 30% the guaranteed pension you would be entitled to at age 60, you can retire before that age (Article 158).

Top-up from the Fondo de Pensiones para el Bienestar (Pension Fund for Wellbeing, the Bienestar Fund). The decree published in the DOF on April 30, 2024 provided that the Fund, administered by Banco de México as trustee, would pay out resources so that workers aged 65 or older whose pension is equal to or below a threshold receive a top-up up to their last salary, without exceeding that threshold. The threshold started at $16,777.68 a month, equal to the average salary registered with the IMSS in 2023 adjusted for estimated 2024 inflation, and it is updated every January 1. For 2026 it is $17,885.85. According to the IMSS, it applies to those who began contributing on or after July 1, 1997, are 65 or older when claiming the vejez pension, meet the weeks required for the year (875 in 2026), have a resolution issued on or after May 2, 2024 and receive a pension below the average salary of their last year of contributions; under a life annuity, they must not have withdrawn surplus funds from the account. The IMSS assesses it automatically and reported 7,224 beneficiaries between 2024 and May 2026. The top-up is subject to the Fund’s sufficiency.

Longevity illustrator

Life expectancy is an average, and planning around an average means accepting roughly a one in two chance of living longer than planned. That is why the Society of Actuaries and the American Academy of Actuaries created the Actuaries Longevity Illustrator, which instead of a single number gives probabilities of reaching different ages. This illustrator follows the same idea with Mexican tables.

It uses the tables the CNSF requires for valuing social security life annuities: EMSSA-15 by sex (Annex 14.2.5-k of the Circular Única de Seguros y Fianzas, the Single Insurance and Surety Circular) with the 2022 base improvement factors (Annex 14.2.7-b), applied generationally: the probability of dying at each future age is projected to the calendar year in which you will reach that age. You can also view the 2026 period version, without future improvement, or the earlier EMSSA-09 table with its 2009 base factors. Under generational EMSSA-15, a 65-year-old man in 2026 has a life expectancy of 20.7 years and a woman 23.4.

These tables describe the insured and pensioner population of the IMSS and the ISSSTE, not any particular person. The mortality multiplier lets you explore scenarios: 0.8 represents someone with mortality 20% lower than the table at all ages, and 1.25 someone with mortality 25% higher. Worked example: cesantía pension at age 62

Roberto registered with the IMSS in 1989, so he can choose Ley 73. He is 62, has 1,600 recognized weeks and his average daily salary over the last 250 weeks is $1,300. He is married and has a 22-year-old son at university. He retires in 2026, with a minimum wage of $315.04. These are the values simulator 1 opens with.

  1. Cap: 25 × 315.04 = $7,876 a day. His $1,300 average is below it, so it is used in full.
  2. Salary group: 1,300 ÷ 315.04 = 4.13 times the minimum wage. Group 4.01 to 4.25: basic amount of 19.39% and annual increment of 2.271%.
  3. Excess weeks: 1,600 − 500 = 1,100 = 21 × 52 + 8. The 8 leftover weeks are fewer than 13, so he earns 21 increments.
  4. Total percentage: 19.39% + 21 × 2.271% = 19.39% + 47.691% = 67.081%. Annual vejez pension: 1,300 × 365 × 0.67081 = $318,299.35.
  5. Cesantía at age 62: 85%, that is, 318,299.35 × 0.85 = $270,554.44.
  6. Family allowances: 15% for his wife and 10% for his student son. 270,554.44 × 1.25 = $338,193.05. It does not exceed the Article 169 cap (1,300 × 365 = $474,500) and is above the annual minimum ($114,989.60).
  7. 2001 decree: 338,193.05 × 1.11 = $375,394.29 a year, that is, $31,282.86 a month, plus a year-end bonus of one monthly payment.
Lesson: if Roberto waited until 65, the age factor would go from 85% to 100% and his pension would rise to $36,803.36 a month, 17.6% more, without contributing a single extra week. Conversely, retiring at 60 would leave him 75% of the vejez pension: a quarter less than at 65, for life. Retirement age is the most powerful lever in Ley 73 after the salary of the last five years.

Assumptions, limitations and disclaimer

Disclaimer: the results are illustrative estimates for educational purposes and do not replace the IMSS resolution, which is the only authority that determines your entitlement and the amount of your pension. Before making decisions, particularly before paying into Modalidad 40, request your statement of contribution weeks, check that all your weeks and salaries are recognized and, if you find inconsistencies, file for a correction.
Average salary. The Ley 73 simulator takes the average as already calculated. The IMSS derives it from the salaries recorded week by week; periods without contributions within the last 250 weeks or misreported salaries change the result.
Rules not modeled. The simulator does not consider preservation of rights, recognition of weeks after interruptions, disability, widow’s or orphan’s pensions, or the 20% assistance supplement for requiring permanent care (art. 166, 1973 LSS), which requires a medical assessment.
Constant pesos. Modalidad 40 and Ley 97 are expressed in 2026 pesos: the UMA, the minimum wage, the Fund threshold and pensions are assumed to keep their real value. If the minimum wage keeps growing faster than inflation, the Ley 73 minimum pension and the first contribution bracket will change.
Social contribution. The table in art. 168, section IV, is applied multiplied by the same 1.3503 factor as an approximation of its quarterly INPC adjustments; the exact amount for each quarter may differ slightly.
Annuity factor. The annuity is calculated for a single life, with monthly payments in advance and the generational EMSSA-15 table. An actual life annuity deducts survivors’ insurance and expenses; use the adjustment field to reflect this. Programmed withdrawal is recalculated every year and may fall if you live longer than expected.
Legal criteria. The cap of 10 or 25 minimum wages and the use of the UMA or the minimum wage have been litigated. By default the simulator follows the IMSS administrative practice and lets you explore the alternative.

Frequently asked questions

How do I know whether I am Ley 73 or Ley 97?
Check the date of your first IMSS registration on your statement of contribution weeks. If it was before July 1, 1997, you belong to the transition generation and, once you meet the requirements, you can choose to retire under the 1973 law or the current one. If your first registration was on or after that date, only Ley 97 applies to you, with an individual account at an AFORE. Having stopped contributing for many years does not take away your right to choose.
How many weeks do I need to retire in 2026?
Under Ley 73, 500 contribution weeks, at age 60 for cesantía or 65 for vejez. Under Ley 97, 875 weeks in 2026: the requirement started at 750 in 2021, rises by 25 each year and will reach 1,000 in 2031. If at 60 or 65 you do not have the Ley 97 weeks, you can withdraw your balance as a lump sum or keep contributing.
What is the Ley 73 minimum pension in 2026?
$10,636.53 a month for cesantía and vejez pensions granted in 2026. It comes from a general minimum wage of $315.04 a day times 365 days divided by 12 months, plus the 11% increase under the Fourteenth Transitory Article of the amending decree published on December 20, 2001. Those already retired receive the inflation adjustment every February, which in 2026 was 3.69%.
Is Modalidad 40 worth it?
For someone under Ley 73 with a low average salary who can still enroll, it usually offers a high return, because it replaces the average of the last 250 weeks and adds increments. In exchange, it requires paying monthly in advance for several years, the rate for salaries of 4.01 UMA or more is 14.438% in 2026 and will rise to 18.8% in 2030, and missing two monthly payments ends the enrollment. Before investing, check your recognized weeks, the five-year window since you left covered employment, your liquidity and your health.
Is the Ley 73 pension cap 25 or 10 minimum wages?
The Supreme Court held in case law 2a./J. 85/2010 and 2a./J. 164/2019 that the average salary for disability, vejez and cesantía pensions is capped at 10 minimum wages. In practice the IMSS keeps the cap at 25, a position its Technical Council ratified in February 2020. For pensions granted in 2026 the debate matters little: the contribution salary is capped at 25 UMA, $2,932.75 a day, so no recent average exceeds 10 minimum wages ($3,150.40).
What is the Bienestar Fund top-up and who receives it?
It is an additional payment that brings the Ley 97 pension closer to the last salary, up to a threshold of $17,885.85 a month in 2026. It goes to those who began contributing on or after July 1, 1997, are 65 or older when retiring for vejez, meet the weeks required for the year, have a pension resolution issued on or after May 2, 2024 and a pension below the average salary of their last year of contributions. The IMSS reviews it automatically and it is subject to the Fund’s sufficiency.
Why does the illustrator use EMSSA tables rather than life expectancy at birth?
Life expectancy at birth also averages in infant and youth mortality, which no longer applies to someone who has reached 60. For a pension, what matters is survival from retirement age. The EMSSA tables are the ones the CNSF requires for valuing social security life annuities, and the generational version projects future mortality improvement: under it, a 65-year-old man in 2026 has a life expectancy of 20.7 years and a woman 23.4.
Can I retire before age 60?
For a Ley 73 cesantía or vejez pension, no: cesantía en edad avanzada begins at 60. Under Ley 97, yes, if the life annuity your balance would buy exceeds by more than 30% the guaranteed pension you would be entitled to at 60, after paying for survivors’ insurance for your beneficiaries (Article 158 of the current law). In practice, few workers accumulate that balance.
